Through the Defense of Marriage Act (DOMA) which passed in 1996, the United States created a federal definition of marriage as "a legal union between one man and one woman.This is nothing more than distraction as husband and wife." It also defined a spouse as "a person of the opposite sex who is a husband or a wife"

The California Supreme Court ruled 4 to 3 to legalize same-sex marriage. Proposition 8, would amend the state constitution, define marriage as between a man and a woman, protect religious freedom and allow same sex partners the same legal rights.
